Warranty
The Stucco RainScreen Panel™ manufactured by Korax Technologies Inc. is designed to ensure that the wall assembly which incorporates this panel is a true vented rain screen wall which satisfies current standards of cavity wall construction. The Panel ensures that any water which enters into the cavity of the panel will be directed to move down the inside face of the panel and then be vented to the atmosphere via weep holes or dry out by means of cross ventilation caused by the weep and vent holes. Korax warrants for ten years that the Panel will prevent water damage to the exterior wall assembly subject to the following terms, conditions and limitations:
- all applicable construction drawings must be reviewed and have a professional architect or engineer stamp affixed evidencing that the basic principles of environmental separation as they relate to building physics have been satisfied;
- this Warranty covers only defects directly attributable to defective material supplied by Korax and does not cover workmanship or defective material supplied by others, whether affiliated with Korax or not;
- the Panel must be installed in strict compliance with Korax’s written guidelines and all other requirements pertinent to the construction of the cavity wall system. Without limiting the generality of the foregoing, the assembly must incorporate air vapour barrier and flashing at the correct location along with control joint and deformation joints, proper connection of the air vapour barrier to accessories such as windows, doors and other penetrations; the wall assembly must be constructed and maintained in accordance with proper moisture and water management standards;
- this Warranty covers only damage to the exterior wall which is directly attributable to the Panel and does not cover damage to any structural components;
- this Warranty does not apply to any failure, defect or damage resulting from or in any way connected with misuse, neglect, improper storage, improper installations or installation not in strict compliance with Korax’s specifications, use of accessories which do not properly support the Panel, impact or foreign objects, fire, hurricane, tornado, or other acts of God; defects in, failure or damage to the foundation of the building, stress fractures, or any other cause not involving inherent manufacturing defect in the Panel;
- no representative of Korax or its dealers or anyone else is authorized to make any change in or modification of this Warranty; this Warranty represents the only warranty provided by Korax respecting the Panel;
- this Warranty is non-transferable and is only for the benefit of the undersigned;
- all claims under this Warranty must be made in writing, shall include a copy of the original Korax invoice and shall be submitted by registered mail to Korax at its then registered office address in the Province of Alberta, immediately upon discovery of the warranty defect or possible warranty defect;
- this Warranty shall be governed by the laws of the Province of Alberta and all parties attorn to the jurisdiction of the courts of the said Province for the purposes of any and all disputes and actions relating to this Warranty;
- Korax or its representatives shall have free access to the Property where the panel alleged to be defective was installed and to remove any necessary samples in order to determine the validity of any claim under this Warranty;
- the Panel must be paid for in full within Korax’s normal credit terms;
- Should any of these terms, conditions or limitations not be strictly complied with, this Warranty shall be null and void
